Introduction

Welcome to the Ministry of Foreign Affairs, Kenya, Treaties Database. The database has been formulated pursuant to section 14 (4) (e) of the Treaty Making and Ratification Act, 2012 (Rev 2014). The Act gives effect to Article 2 (5) of the Constitution of Kenya 2010 which provides that any treaty or convention ratified by Kenya shall form part of the law of Kenya.

The database has comprehensive information on the Multilateral and Plurilateral treaties concluded by the Republic of Kenya. The database contains the text of each treaty/agreement, date and place of adoption, date of signature, date of ratification, entry into force and the relevant domestic Laws. The treaties are categorised into twenty- six (26) thematic areas.

The Ministry of Foreign Affairs as Kenya’s repository of all treaties, is responsible for maintaining records of treaties to which Kenya is a party or to which Kenya is in the process of becoming a party. The maintenance and update of this database shall be done on a continuous basis.

While utmost care has been taken in developing the database, The Ministry of Foreign Affairs, its personnel or agents accept no liability for any loss, damage or expense arising out of, or in connection with, on any reliance or any omissions or inaccuracies in the material contained in this database. Users are therefore encouraged to rely on their own enquiries, skill and care in using the information and check with primary sources.

Treaties

The responsibility for concluding treaties involving the Republic of Kenya lies with the Ministry of Foreign Affairs. The Ministry is responsible for policy aspects, as well as matters of form and procedure.

The Ministry has a Treaty Section within the Legal Division that keeps records of bilateral and multi-lateral treaties involving Kenya. It runs an inquiry service that provides information on treaties. The Ministry also coordinates Kenya’s responsibilities as depositary for certain treaties deposited with the Government of Kenya.

The Treaty Section can provide publication references and links to texts of treaties, but is unable to provide the treaty texts. The Ministry of Foreign Affairs is not responsible for the contents or reliability of the linked websites and does not necessarily endorse the views expressed therein. Listing should not be taken as endorsement of any kind. The Ministry cannot guarantee that these links will work all of the time. The Ministry has no control over the linked websites.
